A PRACTICAL GUIDE TO FSSAI REGISTRATION & LICENSING

FSSAI Registration in India: Updated Eligibility, FoSCoS Application & Food Safety Compliance

Whether you operate a food stall, bakery, restaurant, food processing facility or online food business, the Food Safety and Standards Authority of India (FSSAI) framework generally requires the appropriate registration or licence. This guide explains the March 2026 reforms, current turnover thresholds, document planning, FoSCoS and ongoing responsibilities.

SECTION 01

What Is FSSAI Registration or a Food Business Licence?

FSSAI operates under the Food Safety and Standards Act, 2006. Food business operators (FBOs) must obtain the appropriate registration or licence for applicable activities before carrying on regulated food operations. The approval category depends on the current regulatory criteria and the nature of the business.

Registration is one category of approval. State and Central Licences are distinct categories. A food licence is not a replacement for local trade permits, GST, other sectoral permissions or food safety responsibilities that may also apply.

Start by describing what food is made, handled, stored, transported or sold, and where the operation takes place.

SECTION 02

SECTION 03

Food Businesses That May Need FSSAI Approval

Restaurants, cloud kitchens, caterers, home-based food sellers, grocery and food retail shops, bakeries, manufacturers, repackers, wholesalers, storage operators and food transporters can fall under the FSSAI framework according to their operations.

Online marketplaces, food importers, exporters, brand owners and businesses handling multiple activities may have additional category-specific or Central licensing obligations. Select activities according to actual operations, not only the trade name.

Restaurants & Kitchens

Dine-in, take-away, cloud kitchen and catering operations.

Manufacturers & Packers

Food processing, manufacturing, packing and repacking.

Retail & Distribution

Retailers, distributors, wholesalers and storage operators.

Specialised Activities

Importers, food e-commerce, transporters and certain other operators.

A premises may have more than one Kind of Business endorsed on one appropriate registration/licence; check the latest FoSCoS rules.

SECTION 04

2026 FSSAI Registration, State & Central Licence Thresholds

For new applications made on or after 1 April 2026, the revised turnover-based classification under FSSAI’s March 2026 order is as follows. These figures replace older general thresholds found on some legacy pages.

Use turnover as the starting point, but also verify specific business activity, premises and jurisdiction rules. Particular activities can trigger a Central Licence or other requirements even where turnover alone suggests a different category.

FSSAI Registration

Annual turnover up to ₹1.5 crore.

State Licence

Annual turnover above ₹1.5 crore and up to ₹50 crore.

Central Licence

Annual turnover above ₹50 crore; additional activity-based criteria may apply.

Source: FSSAI Order dated 13 March 2026, effective 1 April 2026. Read official threshold order.

SECTION 05

Registration vs State Licence vs Central Licence: Beyond Turnover

Turnover is important, but the application category may also depend on the Kind of Business, type of location, scale or capacity of certain regulated food operations, import/export activities and whether the operator has premises across different states.

A food importer or multi-state business should not self-select registration solely because a local unit has modest sales. Validate every applicable criterion using the official FoSCoS portal and current FSSAI instructions.

When rules overlap, follow the current FSSAI order and relevant official eligibility/category guidance, rather than an outdated comparison chart.

SECTION 06

Kinds of Business (KoB) on FoSCoS

FoSCoS asks businesses to declare the actual Kind(s) of Business (KoB). Examples include food manufacturing/processing, retailer, distributor, wholesaler, food service, storage, transportation and e-commerce activities.

Food products and operational capacity can also matter. Missing or incorrectly declaring an activity may lead to an unsuitable approval. Check the correct KoB list before submission.

Manufacture / Processing

Identify applicable processes, products and facility capacity.

Food Service

Describe kitchen, restaurant, catering and service formats accurately.

Trading / Storage

Map warehousing, cold storage, wholesale and retail activities.

Digital / Import

Check additional e-commerce or importer requirements as applicable.

SECTION 07

Eligibility and Information Checklist Before Applying

Review the business constitution, contact details, food activity, estimated turnover, premises, responsible person and product categories. Determine whether each premise needs its own approval and whether any head-office or multi-state licensing provision applies.

  • Full legal name and appropriate business constitution
  • Complete premises address and possession proof where required
  • Responsible person / authorised signatory identity
  • Food business activities, products and capacity information
  • Business contact email/mobile and relevant tax/business records

Document requirements vary by registration/licence type and KoB; use the FoSCoS documents checklist for your exact application.

SECTION 08

Documents Commonly Needed for FSSAI Registration

Depending on the application route, applicants may need identity information, a photograph, business or premises details and prescribed declarations. Do not rely on one generic list: the official portal shows requirements based on the business category.

Keep clear, current documents and make sure the responsible signatory, establishment address and activity match the actual business. Incorrect premises details are a common source of discrepancies.

Use FoSCoS Documents Required for category-specific lists.

SECTION 09

Additional Documents for State and Central Licences

Manufacturing or processing licences may involve an operational layout, equipment and machinery particulars, proposed product categories and documents about food safety management. Other categories may require business-specific declarations or authorisations.

Company/LLP/partnership structures can need authorised signatory documentation and constitution details. Proof of lawful possession or use of the premises should align with FSSAI’s official documentary guidance.

Premises Records

Possession documents and site details as required.

Operations

Layout, equipment and capacity for applicable manufacturers.

Product Information

Food category list and relevant activity particulars.

Business Identity

Constitution and authorised persons as required.

Follow the checklist for the actual Kind of Business; not every document applies to every applicant.

SECTION 10

How to Apply Through the Official FoSCoS Portal

The official application system is the Food Safety Compliance System (FoSCoS). Select the place of operation, choose the appropriate registration/licence and Kind of Business, fill in the operator details and submit the required information.

  1. Identify the premises and true food business activities.
  2. Confirm registration/State/Central category against the latest rules.
  3. Complete the FoSCoS application and upload required records.
  4. Respond to official requests or corrections where applicable.
  5. Retain the registration/licence record and observe continuing food safety duties.

Approval is an official regulatory decision. No independent consultant can guarantee acceptance.

SECTION 11

One Premises, Multiple Locations and Multi-State Operations

FSSAI licensing is tied to the operator’s relevant premises and activities. Separate premises may require their own approvals; a business carrying out multiple KoBs at one premises should review the FoSCoS endorsement requirements.

Multi-state businesses and head-office functions may trigger separate Central and State licensing considerations. Review the actual locations and operations, especially for chain restaurants, franchise operators, warehouse networks and e-commerce businesses.

Business groups should map every operational address before applying, rather than treating one certificate as automatically covering all locations.

SECTION 12

Food Safety, Hygiene, Labelling and Operational Compliance

An FSSAI registration or licence is only one component of food compliance. Operators must follow applicable food safety, hygiene, storage, packaging, handling, labelling and traceability obligations relevant to their category.

Food manufacturers, caterers, retailers and transporters have different operational risks. Keep suitable hygiene practices, personnel records, labelling information and safety procedures in place. Relevant reporting, records or returns continue where the law requires them.

Hygiene & Handling

Appropriate hygiene and preventive practices for operations.

Storage & Traceability

Maintain records suited to food movement and inventory.

Packaging & Labels

Apply product-specific labelling rules where relevant.

Ongoing Records

Maintain applicable records, returns and compliance evidence.

FoSTaC, Schedule 4 and specific product standards may be relevant depending on the kind of food business.

SECTION 13

Perpetual Validity Under the 2026 FSSAI Reforms

The March 2026 FSSAI amendment introduced perpetual validity of applicable registrations and licences: they generally remain valid unless suspended, cancelled or surrendered, subject to the amended framework and continuing compliance.

FSSAI’s official FAQ explains that operators are not required to follow the earlier routine renewal model for these approvals. However, this does not remove obligations to keep operating information current, comply with hygiene/safety rules or meet any applicable payment, audit or inspection requirements under the new framework.

Follow current FoSCoS guidance for your existing or new approval and any transition provisions. See FSSAI March 2026 FAQs.

SECTION 14

Modification, Suspension, Cancellation and Food Business Changes

A change in legal constitution, premises, product category, scale or Kind of Business may require a modification, new approval or other update through the official system. The right action depends on the kind of change and applicable rules.

Business closure, surrender, suspension or cancellation should be handled in accordance with competent authority instructions. Do not continue relying on an approval that no longer accurately covers your premises or activities.

Keep copies of official correspondence, amended approvals and supporting documents for your records.

SECTION 15

Common Mistakes to Avoid in FSSAI Applications

Frequent errors include using pre-April-2026 turnover criteria, selecting a mismatched Kind of Business, inconsistent premises documentation, omitting special Central licence triggers, entering the wrong food category, or assuming registration replaces other permissions.

  • Do not copy eligibility figures from stale webpages.
  • Do not select a licence only from turnover without checking activity criteria.
  • Do not use the wrong address or applicant constitution.
  • Do not treat approval as a substitute for hygiene and labelling compliance.
  • Do not confuse a private consultant with the official government portal.

Match application information with your real business operations and review official advisories for recent changes.

SECTION 16

Frequently Asked Questions About FSSAI Registration & Licensing

Most regulated food business operators must hold the appropriate FSSAI registration or licence for their activity and premises. The category depends on the current rules, activity and business circumstances.

Under FSSAI’s 13 March 2026 order, registration applies to annual turnover up to ₹1.5 crore for new applications on or after 1 April 2026, subject to other applicable criteria.

The revised general turnover band is above ₹1.5 crore and up to ₹50 crore, but the applicant must also verify the type of activity and other eligibility conditions.

The general turnover threshold is above ₹50 crore. Certain food business activities, import-related operations or other regulatory criteria can also affect the category, irrespective of the turnover band.

No for new applications governed by the order effective 1 April 2026. Some older official pages still show the earlier figure; the March 2026 FSSAI order supersedes the earlier general threshold.

The 2026 amendment introduced perpetual validity: approvals generally remain valid unless suspended, cancelled or surrendered, while continuing safety, hygiene and other compliance requirements still apply.

No. It changes the validity framework, not the operator’s continuing responsibilities for appropriate hygiene, safety, reporting or compliance.

Not automatically. Premises-based and multi-state or head-office licensing provisions must be examined on the actual location and activity structure.

Yes, subject to the facts of the activities and the current registration/licensing criteria. The correct category depends on the nature and scale of food operations.

The FoSCoS checklist depends on the Kind of Business and approval category. Identity, premises details, authorised person information, activity data and, where applicable, manufacturing or product records may be needed.

Use the official FoSCoS system at https://foscos.fssai.gov.in/ to apply, track an application or access licensing resources.

No. Online Tax Filings provides independent tax, business and compliance guidance. FSSAI and its FoSCoS service are official government regulatory channels.

SECTION 17

Official FSSAI and FoSCoS Government Resources

These government sources contain current regulatory material, eligibility information, application facilities and supporting guidance. For updates, rely on the most recent FSSAI orders and the current FoSCoS portal, especially where older pages still show superseded thresholds.

Regulatory information can change. Confirm the applicable official position before making a filing.
