IN-DEPTH TAX RESIDENCY CERTIFICATE GUIDE
Learn when an Indian TRC or foreign TRC is relevant, how Form 10FA/10FB maps to Form 42/43, what records support tax residence, and how the application, acknowledgement and certificate differ.
A Tax Residency Certificate (TRC) is an official confirmation from a tax authority that an applicant is a tax resident of the issuing jurisdiction for a stated period. It is often used when a person or enterprise needs to demonstrate tax residence for income connected with another country and a Double Taxation Avoidance Agreement (DTAA).
For an Indian tax resident, the relevant Indian income-tax authority examines the application and may issue an Indian TRC. A non-resident seeking certification of residence in another country must approach the tax authority of that country. Online Tax Filings helps applicants identify the proper jurisdiction, year, evidence and application pathway.

Document and filing guidance
Practical note: A TRC supports residence evidence; it does not by itself approve a tax refund, determine the character of income or guarantee treaty relief.
An Indian TRC is requested by a person who claims to be tax resident in India and needs a certificate, commonly for presentation in a foreign jurisdiction. Under the applicable Indian rules, the application is addressed to the Assessing Officer using the prescribed form.
A foreign TRC is issued by the overseas revenue authority to that country’s resident. An Indian business making a payment to a foreign vendor may request that certificate for treaty review, but the Indian e-filing portal cannot issue a certificate of another country’s tax residence. These are different evidence-collection workflows.
Requests certificate in India
Approaches overseas authority
Checks foreign certificate
Reviews jurisdiction and period
Practical note: Do not confuse an Indian TRC application with the separate Form 10F/Form 41 declaration filed by a non-resident for Indian treaty benefits.
For matters under the Income-tax Act, 1961, Rule 21AB provided Form 10FA as the resident taxpayer’s application and Form 10FB as the residence certificate issued by the Assessing Officer. Older-year cases continue to require identification of the applicable statutory framework.
For Tax Year 2026–27 onwards under the Income-tax Act, 2025, section 159 and Rule 75 of the Income-tax Rules, 2026 specify Form 42 for the application and Form 43 for the certificate. These forms are not interchangeable for every tax year: select the law, tax year and form together.
10FA — application
10FB — certificate
42 — application
43 — certificate
Practical note: FY 2025–26 / AY 2026–27 remains an earlier-law period; Tax Year 2026–27 begins 1 April 2026 under the new Act.
Indian residents may include individuals, Hindu Undivided Families, companies, firms and other persons whose status is recognised under the relevant law. The official Form 42 guidance describes applications by registered e-filing users with active PAN, subject to residency facts and the Assessing Officer’s satisfaction.
The applicant should have a genuine cross-border purpose for the requested certificate and be able to substantiate residence during the specified tax year. Merely holding an Indian PAN, Aadhaar, registered office or Indian passport does not automatically prove the required tax-resident status for the relevant period.

Practical note: The assessing authority determines eligibility on the material provided. A consultant cannot issue a government TRC on the applicant’s behalf.
Residence is a legal conclusion for a particular tax year, not a lifelong status. For individuals, physical presence, travel chronology and applicable exceptions must be considered. For companies or other persons, entity-specific tests and factual management or residence considerations can be relevant.
The Income-tax Act, 2025 applies its residence rules to tax years beginning on or after 1 April 2026. Years beginning before that date continue under the 1961 Act. An applicant with international travel, dual-country connections or changing residency should document the precise year and supporting facts before requesting a certificate.
Identify the correct year first
Check physical presence
Review applicable entity tests
Keep a traceable record
Practical note: A foreign residence permit or citizenship alone does not establish Indian income-tax residence, nor does an Indian bank account.
Form 42 requests the period for which the TRC is applicable and the purpose for which it is sought. The official guidance describes a tax-year-wise Indian TRC process: where coverage spans multiple tax years, separate applications may be required for the corresponding years.
An overseas payer, investment institution or tax authority may ask for residence evidence related to a particular income receipt. Match that request with the applicant’s actual residence status and the certificate period; a certificate for one year should not be presented as proof of a different period without review.
Identify applicable tax year
State cross-border use
Align transaction context
Check separate filing needs
Practical note: Do not promise an open-ended or perpetual certificate. Confirm the period and wording appearing on the issued document.
An individual seeking an Indian TRC should review the documents supporting identity, stay in India and residence for the requested period. The Form 42 manual provides applicant-specific attachment fields and explains that relevant passport or proof-of-stay records may be required, depending on the case.
Travel history, residential address and purpose of the request should agree with the application. Where passport entry records alone do not explain movements, suitable supporting evidence may be needed. Avoid uploading unrelated sensitive documents merely because they are available.

Practical note: Use the current Form 42 attachment instructions for the specific applicant. Keep complete passport numbers and travel documents out of the public enquiry form.
For a company, LLP, partnership or other non-individual applicant, registration or incorporation evidence and the basis of the entity’s tax residence can be central. The Form 42 manual identifies a different attachment path for persons other than individuals, rather than applying the individual passport checklist unchanged.
Confirm the legal name, PAN, constitution, registration jurisdiction, registered and communication addresses, and authorised verifier. Where the residency claim depends on effective management or other law-specific factors, the applicant should maintain appropriate decision-making and governance records.

Practical note: Documents establish facts, not automatic eligibility. Any unusual cross-border management structure warrants case-specific tax review.
For a Tax Year 2026–27 TRC application, sign in to the official Income Tax e-filing portal, choose e-File → Income Tax Forms → File Income Tax Forms, select the Income-tax Act, 2025 forms and open Form 42. Select the relevant tax year and begin the application using the taxpayer’s own verified account.
The official form has four panels: Part A — Applicant Particulars; Part B — TRC Details; Attachments; Verification. Complete each panel accurately, save the information and review the generated preview before proceeding to verification. Portal navigation may evolve; use the current official form manual for on-screen instructions.
Use registered PAN login
Select correct Act and year
Complete four panels
Review preview carefully
Practical note: The e-filing account, passwords, OTPs and DSC remain under the taxpayer’s or authorised signatory’s control.
Part A records identity and contact particulars, including information drawn from the e-filing profile. Part B requires details pertinent to residence: applicant status, nationality where applicable, incorporation or registration details for entities, address during the requested period, basis of Indian residence, certificate period and stated purpose.
Check for variations between the PAN record, travel or registration evidence, and the period sought. If key profile details are inaccurate, the official manual advises updating the profile and, when needed, preparing a fresh draft so that the updated details flow into the application.

Why overseas TRC is needed
Practical note: Small discrepancies in address, entity status or relevant dates may require clarification. Do not supply guesses to complete a mandatory field.
After reviewing the applicant’s supporting files, complete the Attachments and Verification panels. Form 42 includes separate attachment categories for individuals and non-individuals, along with a facility for additional relevant documents. Review the entire application preview before confirming its contents.
The portal supports the verification methods available to the applicant, such as OTP, EVC or registered DSC as applicable. On successful filing, retain the transaction ID and acknowledgement receipt number. These identify the submitted application; they are not, by themselves, the final TRC.

Keep filing identifiers
Practical note: Acknowledgement of Form 42 only confirms submission. Certificate issuance remains subject to review and satisfaction of the assessing authority.
Under Rule 75, the Assessing Officer considers the submitted Form 42 application and, if satisfied, issues the certificate of residence in Form 43. The applicant should preserve both the filed application and the final certificate, if granted, and respond accurately to any legitimate requests for supporting evidence.
When receiving the issued document, compare the name, taxpayer identification, residence jurisdiction, certificate period and any authentication information to the original request. Notify the appropriate authority through the official channel if a material discrepancy is identified; do not alter a government-issued certificate manually.

Practical note: No service provider can guarantee an assessing officer’s decision. Eligibility and accuracy govern issuance.
An Indian resident may need a TRC while receiving income abroad, establishing residence with a foreign payer or supporting a treaty-based position in another jurisdiction. The requesting foreign authority or payer may specify how it accepts the document and whether additional supporting evidence is needed.
A TRC is a residence credential, not a blanket exemption from foreign tax. The applicable treaty, nature of the income, beneficial ownership, local procedures and other facts may affect tax treatment. Confirm whether the foreign recipient needs an electronic document, certified copy or other authentication according to its own rules.
Foreign payer or authority
Tax-resident evidence
Country- and income-specific
Check foreign requirements
Practical note: Legalisation, translation or apostille may be separately requested by the receiving authority; these are not automatically part of the Indian TRC filing process.
An Indian payer dealing with a non-resident may receive a TRC issued overseas. Review whether the named taxpayer, issuing authority, country and residence period correspond to the transaction. Examine whether the certificate appears genuine and adequately supports the claimed residence.
Indian treaty relief may require additional particulars supplied by the non-resident through the applicable Form 10F or Form 41 process. That declaration is covered by a separately approved service page. This TRC page focuses on obtaining or assessing the residence certificate itself, not completing remittance forms or withholding returns.
Foreign competent authority
Match legal recipient
Check transaction overlap
Separate treaty declaration
Practical note: If the foreign tax authority issues its TRC in another language or format, evaluate any translation or certification required for the specific Indian tax use.
Common errors include using an old statutory form for a new tax year, applying for an overseas TRC through the Indian portal, asking for a period unsupported by residence facts, incomplete travel records, mismatched legal names, or attaching an acknowledgement in place of the issued certificate.
A robust pre-submission review checks jurisdiction, form, year, applicant type, address, evidence, verifier and end-use as independent items. A later discrepancy should be addressed through the competent authority or portal process rather than changing a PDF copy or overstating its legal effect.
Correct issuing country
Match relevant tax year
Support claimed residence
Use issued certificate
Practical note: Keep the related Form 10F/41, remittance and NRI TDS filings separate to prevent overlapping advice or inconsistent statements.
It is an official tax-authority document certifying residence for a stated period and jurisdiction. It is evidence for applicable tax or treaty procedures, not a guarantee of reduced tax.
The relevant Indian Assessing Officer may issue it after reviewing the resident applicant’s supporting Form 42 or applicable earlier-law application.
Form 42 is the application and Form 43 is the certificate, under Rule 75 for Tax Year 2026–27 onwards.
These are earlier-law equivalents: Form 10FA was the resident applicant’s request and Form 10FB the issued certificate under Rule 21AB of the 1962 Rules.
No. The relevant foreign tax authority issues its country’s residence certificate. India cannot certify another country’s tax residence.
No. Form 10F, or Form 41 under the new Act, furnishes additional non-resident treaty information; a TRC is separately issued by the country of residence.
No. PAN is an identification and filing credential. Residence must be tested under the substantive rules applicable to the relevant year.
The official Form 42 guidance is tax-year-wise. If the required coverage spans different tax years, check the corresponding applications and periods.
The current Form 42 manual distinguishes individual attachments; passport or other evidence of stay and accurate residence-period details may be relevant to the facts.
The manual includes a separate non-individual attachment category; registration or incorporation proof and records supporting the applicable residence test may be important.
No. It confirms submission. Form 43 is issued by the assessing authority if satisfied with the request.
We can help identify the correct issuing jurisdiction, statutory form, supporting documents and portal steps, and review the final certificate details. Never disclose OTPs or passwords in the initial form.
Use these official Income Tax Department resources to check current resident TRC applications, Form 42 instructions, previous-law Form 10FA/10FB and evidence requirements. Verify the tax year and current portal instructions for the case.
Practical note: For Tax Year 2026–27 Indian residents apply in Form 42; an authorised officer may issue Form 43. Older-year Indian TRC requests use their relevant earlier-law forms. A foreign TRC is issued by the foreign competent authority.
Online Tax Filings can help review whether an Indian or overseas TRC is required, assess the correct tax year and supporting records, check Form 42 or relevant earlier-year requirements, and organise acknowledgement and final-certificate information.
For a first enquiry, share the requested issuing country, period, type of applicant and why the certificate is required. We can explain documents to prepare and the relevant official authority, without promising the certificate will be granted.
Do not place passwords, OTPs, travel-document scans, full tax identification numbers or sensitive banking information in the public enquiry field.
