A PRACTICAL GUIDE TO ESI REGISTRATION

ESIC Coverage, Employer Registration, Insured Persons & FAQs

Understand when the ESI scheme can apply, the employee wage criteria, documents, official portals, employee identification, medical and cash benefits, and ongoing employer obligations. Coverage remains fact-specific.

SECTION 01

What Is ESI Registration (ESIC Employer Registration)?

Employees’ State Insurance (ESI) is an employment-linked social security scheme administered by the Employees’ State Insurance Corporation (ESIC). Where the law applies, establishments are registered in the official ESIC system and eligible employees are brought under insured-person coverage.

ESI is designed to provide access to medical care and certain statutory cash benefits for insured persons and qualifying family members, subject to scheme eligibility. The establishment’s employer code and an employee’s insurance number serve different purposes.

Employer registration

Connect a covered establishment with its ESIC employer account.

Insured employees

Record eligible workers and their insurance identification.

Employee welfare

Help qualifying insured persons access scheme benefits.

Continuing compliance

Maintain wages, contributions and staff records.

Coverage and benefits are determined by the applicable law and official ESIC systems, not by a third-party consultant.

SECTION 02

How Online Tax Filings Assists With ESI Registration

Online Tax Filings helps organisations assess potential ESI applicability, organise the required establishment details and understand the official employer-registration workflow. Assistance can be relevant to proprietorships, partnerships, LLPs, private companies and other employing organisations.

We focus on sensible preparation: workforce assessment, legal-entity consistency, employer information, responsible handling of employee records and clarity about post-registration duties.

Eligibility review

Examine workforce strength, locations and business activity.

Employer documents

Organise PAN, legal name, signatory and business details.

Portal guidance

Understand the appropriate ESIC or government registration route.

Compliance orientation

Plan employee enrolment, wages and reporting.

Online Tax Filings is an independent advisory service. We do not issue ESIC codes or represent ourselves as ESIC.

SECTION 03

Which Businesses and Establishments May Require ESIC?

The ESI framework covers qualifying establishments and employees subject to current statutory conditions. Businesses should examine whether their factories, shops, hotels, restaurants, service operations, educational or medical institutions and other activities come within the applicable rules.

The nature of the establishment, direct and contract labour, work locations and previously granted coverage can matter. Having GST registration or incorporating a company does not alone resolve ESIC applicability.

Shops and services

Review headcount and establishment classification.

Factories and units

Examine non-seasonal factory status and worker arrangements.

Medical and education

Consider coverage within the updated social security framework.

Contract labour

Assess personnel deployed through contractors and labour suppliers.

The applicable district notifications, employment conditions and any exceptions must be checked for the particular establishment.

SECTION 04

ESI Applicability and the 10-Person Coverage Rule

The Code on Social Security, 2020 was brought into effect from 21 November 2025. ESIC has explained that Chapter IV coverage generally applies to establishments employing 10 or more persons, subject to applicable provisions and exceptions. Coverage can also extend to a notified hazardous or life-threatening occupation even when one employee is employed.

ESIC communications also explain an option for voluntary coverage for establishments with fewer than 10 employees under the relevant conditions. Employers should not apply an older blanket 20-person rule without checking the current Code and notifications.

General threshold

10 or more persons for covered establishments under the updated framework.

Hazardous occupation

Special notified activities may attract coverage with even one worker.

Below threshold

Voluntary ESI coverage may be possible under statutory conditions.

Existing registrations

Check prior employer codes, branches and historic coverage.

Review Code on Social Security provisions and current ESIC notices for your establishment, workforce and district.

SECTION 05

ESI Employee Wage Ceiling and the New Wage Definition

ESIC’s coverage guidance lists a monthly employee wage ceiling of ₹21,000, and ₹25,000 for persons with disabilities, as the relevant coverage references. These are employee-level conditions, not an exemption for the employer itself.

From 21 November 2025, the Code on Social Security introduced a revised definition of wages for ESI purposes. Basic pay, dearness allowance, retaining allowance and the statutory treatment of excluded pay components must be assessed; employers should not mechanically apply an older gross-salary approach.

  • ESIC-published general wage ceiling: ₹21,000 per month.
  • ESIC-published wage ceiling for persons with disabilities: ₹25,000 per month.
  • Assess basic pay, dearness allowance and retaining allowance under Section 2(88).
  • Review statutory add-back treatment for excluded pay components.
  • Evaluate each employee’s insurance status and current applicable guidance.

Wage ceilings, calculation bases and exclusions may change through notifications. Verify the latest official position before payroll decisions.

SECTION 06

Mandatory ESIC Coverage and Voluntary Registration

Mandatory employer coverage and voluntary registration are not the same. Where the establishment meets the legal applicability conditions, an employer should examine registration and compliance duties. The Code also provides a mechanism for voluntary participation in eligible below-threshold cases.

Before seeking a fresh code, confirm whether the organisation already received ESIC registration through incorporation workflows, a previous portal application or a prior employing establishment.

Mandatory registration

Assess Code coverage and workplace facts.

Voluntary participation

Review conditions before opting into coverage.

MCA incorporation route

Identify ESIC registration generated through company incorporation.

Earlier ESIC code

Reconcile existing employer details instead of creating duplicates.

Voluntary registration should be considered with an understanding of continuing statutory duties.

SECTION 07

Documents and Information for ESIC Employer Registration

Exact documentation is determined by the government portal and the establishment’s constitution. Align the legal name, PAN, business address, contact details and authorised signatory particulars with underlying records before starting registration.

The employer may also need details of its business activity, relevant locations, employment particulars, bank information and registration credentials. Particular employee identity and family information is ordinarily managed later through authorised ESIC processes.

  • Establishment legal/trade name, constitution and PAN.
  • Registered and operating address with contact information.
  • Incorporation, partnership, proprietorship or other applicable records.
  • Owner/director/authorised signatory particulars.
  • Business activity, branches, employee strength and workforce categories.
  • Bank or other establishment details requested in the official portal.

Only provide employee Aadhaar, family records and confidential information through appropriate authorised and secure channels.

SECTION 08

Official ESIC Registration Process: Employer Checklist

A practical ESIC registration starts with confirming the employing entity and whether registration already exists. The Ministry’s Shram Suvidha service and the ESIC Employer Portal provide official online pathways; newly incorporated companies may have ESIC registration information routed through MCA processes.

The business must provide accurate details, complete the live prescribed checks and retain any official acknowledgement and generated employer code. Portal steps may differ with entity type and government workflow changes.

Determine the route

Check ESIC Employer Portal, Shram Suvidha or MCA applicability.

Reconcile business data

Check PAN, establishment identity, signatory and work locations.

Submit authorised details

Use the government’s current registration and verification forms.

Preserve employer records

Keep official code, credentials and registration correspondence secure.

Never use a lookalike website as if it were a government ESIC registration portal.

SECTION 09

ESIC Employer Code, Employer Portal and Establishment Changes

The ESIC employer code identifies the establishment in the official system. It is distinct from an insured person’s individual insurance number. Employers use official access to manage covered staff and contribution-related functions.

Changes in company particulars, relevant work locations, authorised users or establishment details should be handled through the applicable ESIC procedures rather than leaving outdated records in the portal.

Employer code

Maintain one accurate record of official establishment identification.

Secure portal access

Control authorised users, recovery details and login credentials.

Branch information

Review location and subunit details as applicable.

Registration history

Avoid accidental duplicate accounts or mixed entity details.

Use the current ESIC Employer Portal and retain acknowledgements of submitted changes.

SECTION 10

Employee Insurance Numbers and Insured-Person Registration

When a covered employee enters insurable employment, the employer must maintain the required insured-person particulars in ESIC systems. ESIC guidance distinguishes employee registration from establishment registration and explains that insurance identification accompanies a worker across eligible employment.

Employers should review whether a new worker already has an ESIC insurance number. Correct identity, household and employment data are important for accessing benefits and avoiding duplicate records.

  • Check the employee’s existing ESIC insurance number where available.
  • Verify the eligible employee details under authorised procedures.
  • Record required joining, family, contact and employment information.
  • Use prescribed ESIC processes for identity documents and changes.
  • Keep personal data access restricted to responsible staff.

Do not collect or expose full employee identifiers through a public marketing form or informal messages.

SECTION 11

ESI Benefits, e-Pehchan and Employee Medical Security

Under the ESI scheme, qualifying insured persons and dependants may receive medical services and specified cash benefits, subject to the governing eligibility and contribution conditions. Benefit categories include sickness, maternity, disablement and dependants’ benefits in relevant circumstances.

Employers support access by maintaining accurate online insured-person details. ESIC offers identity documentation and e-Pehchan-related functions through official employer and insured-person services.

Medical support

Qualifying insured persons and families can access scheme healthcare.

Sickness and maternity

Cash benefits may apply under their own eligibility conditions.

Employment injury

ESI provides statutory employment-injury protections.

e-Pehchan readiness

Correct employee and family information supports scheme access.

Benefit eligibility is governed by the legislation and ESIC; employer registration does not guarantee every benefit for every employee.

SECTION 12

ESI Contribution Rates, Wages and Payroll Handling

ESIC’s contribution page publishes an employee contribution rate of 0.75% and an employer contribution rate of 3.25% of applicable wages. These are statutory contribution percentages, not professional service charges. Special cases and exemptions may affect employee deductions.

Payroll must use the applicable wage definition and verify which employees are insured. The revised statutory wages definition under the Code on Social Security requires employers to examine salary components before calculating contributions.

  • Identify insured employees and relevant covered payroll.
  • Check wage components using the applicable statutory definition.
  • Apply current ESIC contribution rates and employee-specific exceptions.
  • Reconcile employer and employee shares with salary records.
  • Retain official contribution details and payment acknowledgements.

Confirm current contribution rules directly from ESIC; do not assume every employee has an identical deduction.

SECTION 13

ESIC Monthly Contributions, Challans and Compliance Records

Employer responsibility continues after registration. The official ESIC employer services include employee enrolment, monthly contribution reporting, challans, payment records and employer information management.

Employers should reconcile enrolled employees with payroll, contractor inputs where relevant, wage records and the amounts reported in the ESIC system. Reliable documentation helps address discrepancies and queries.

Employee list

Match insured-person records to eligible staff and workforce changes.

Wage reconciliation

Use accurate pay components for statutory reporting.

Official reporting

Prepare and review contributions and challans on government systems.

Evidence retention

Safeguard records, receipts, staff changes and correspondence.

Use ESIC’s current official instructions for contribution and reporting deadlines; this page does not provide processing-time estimates.

SECTION 14

Contract Employees, Multi-Location Businesses and PF Comparison

ESI compliance questions often arise with contract workers, labour supply, multiple locations and businesses already covered by EPFO. The principal employer may have statutory responsibilities even where personnel work through an immediate employer or contractor.

EPFO and ESIC are separate schemes with different eligibility, wage and reporting tests. A common government registration workflow does not mean that a single code or deduction replaces obligations under both systems.

  • Review direct and contractor workforce arrangements.
  • Map branches and working locations to the right employer identity.
  • Assess whether employees are already covered or have existing insurance numbers.
  • Keep ESIC and EPFO payroll classifications and reporting distinct.

Contractor responsibility, branch treatment and scheme applicability require a fact-specific legal review.

SECTION 15

ESIC Registration and Payroll Mistakes to Avoid

Avoid treating employee wages as the same thing as establishment coverage. Other recurring issues include submitting inconsistent employer PAN or names, choosing an inappropriate registration route, overlooking existing employer codes and failing to enrol eligible employees accurately.

Payroll compliance can also be affected by incorrect wage components, duplicate insurance numbers, missing contractor information and outdated employee or location records.

Outdated thresholds

Use Code-era ESI guidance rather than old blanket coverage tests.

Incorrect wage basis

Reassess allowances under the revised legal wages definition.

Duplicate records

Check existing employer and insured-person IDs before creating new ones.

Unreconciled payroll

Match employee data, eligibility and contribution reporting.

Do not use temporary special drives from earlier years as evidence of current amnesty or registration relief.

SECTION 16

Frequently Asked Questions About ESI Registration

It is official registration of a covered employing establishment under the ESI social security framework. The employer code is distinct from individual employees’ insurance numbers.

ESIC communications under the Code on Social Security, effective from 21 November 2025, describe coverage generally for establishments with 10 or more persons, subject to applicable provisions and exceptions. Review your facts and current notifications.

Voluntary coverage may be possible for eligible establishments under the Code, subject to statutory conditions. Employer responsibilities should be reviewed before opting in.

Special rules may apply to a notified hazardous or life-threatening occupation where one employee is employed. This is not a general one-person rule for every business.

ESIC publishes ₹21,000 per month as the general employee wage ceiling and ₹25,000 for persons with disabilities. The revised Code wage definition and any current notifications must be considered.

Yes. ESIC has issued guidance on Section 2(88) of the Code on Social Security, applicable from 21 November 2025. Employers should reassess payroll components rather than relying on old assumptions.

ESIC’s official contribution page lists 3.25% for the employer and 0.75% for the employee, based on applicable wages, subject to rules and qualifying exemptions.

Typical employer information includes PAN, legal constitution, address, contact/signatory details and employment particulars. The official portal determines the final requirements.

Use the official ESIC Employer Portal, authorised Shram Suvidha registration service or the applicable MCA incorporation workflow. Avoid third-party pages impersonating the government.

It is the individual insurance identifier linked to a worker’s ESI record. An eligible worker with an existing number should not receive an unnecessary duplicate record.

No. They are separate social-security schemes. The government may offer a combined registration service, but legal coverage, employee eligibility and contribution reporting differ.
