A DETAILED GUIDE TO BUSINESS INCOME TAX RETURN FILING

Business ITR Filing in India: Forms, Books, Presumptive Tax & Audit

Business income tax return filing connects accounts, legal entity status and statutory tax adjustments. This guide covers return form selection for proprietorships, partnerships, LLPs and companies; trading records; profit computation; depreciation; presumptive income; tax audit; and filing controls. Individual salary-only ITRs, TDS return filing and income tax notices are separately approved services.

SECTION 01

What Business Income Tax Return Filing Covers?

A business ITR reports taxable business or professional income together with relevant other income, deductions, taxes paid and mandatory entity-level disclosures for the selected period. The required return form depends first on who carries on the business: a proprietor, HUF, firm, LLP or company.

Preparing a reliable return starts with books or supporting transactional records, not merely a turnover figure. The goal is to explain how revenue, expenses, assets, liabilities and statutory adjustments produce the income reported to the tax department.

Legal status

Identify the actual taxpayer.

Income activity

Classify business and professional receipts.

Return schedules

Map financial records into the selected ITR.

Compliance checks

Review taxes, audit and verification.

Practical note: A GST registration number does not itself establish which income-tax return form a business must file.

SECTION 02

Choosing ITR-3, ITR-4, ITR-5 or ITR-6

For AY 2026–27, ITR-3 generally covers individuals and HUFs with relevant business or professional income who are not eligible for simplified returns. ITR-4 (Sugam) is an optional form for qualifying resident individuals, HUFs and resident firms other than LLPs with presumptive income and the applicable income restrictions.

ITR-5 is generally used by partnership firms, LLPs and certain other non-company entities. ITR-6 generally applies to companies other than those claiming exemption under section 11. Special cases and return conditions require entity-specific review before selection.

ITR-3

Individual or HUF business schedules.

ITR-4

Eligible simplified presumptive cases.

ITR-5

Firm, LLP and other eligible entities.

ITR-6

Companies in the applicable category.

Practical note: A limited liability partnership should not use ITR-4 merely because its receipts are modest.

SECTION 03

FY 2025–26, AY 2026–27 and the 2025 Act Transition

Business income for FY 2025–26 belongs to assessment year 2026–27 and the return is governed by the Income-tax Act, 1961. The Income-tax Act, 2025 applies to income from tax year 2026–27, which begins on 1 April 2026, under the new tax-year framework.

Even though two periods share the numerals 2026–27, they are different income periods. The applicable audit forms, ITR schedules and income calculations should always match the year selected on the official e-filing portal.

FY 2025–26

Period of the business transactions.

AY 2026–27

Return under the 1961 Act.

TY 2026–27

Income year under the 2025 Act.

Portal selection

Use year-specific notified forms.

Practical note: Do not mix sections or return labels from the old and new Acts in the same assessment-year filing.

SECTION 04

Books of Account and Source-Document Readiness

Accurate business returns rely on sales and purchase registers, bank books, cash books, general ledgers, vouchers, debtor and creditor schedules and, where relevant, inventories. The level of record keeping required depends on the business, profession, turnover and statutory regime.

We organise source records by account head, investigate unusual journal entries and identify reconciliations that must be resolved before extracting ITR figures. Business owners should retain underlying invoices and transaction evidence even when accounting software generates summaries.

Sales books

Trace invoices and receipts.

Purchase register

Support direct costs and input entries.

Bank and cash

Match recorded movements.

Ledger review

Resolve unexplained or duplicate entries.

Practical note: A trial balance that balances mathematically can still contain incorrect classifications.

SECTION 05

Business Turnover, Receipts and GST Cross-Checks

A business may have accounting revenue, GST taxable turnover, exempt or non-GST supplies and other receipts with different reporting treatments. Reconciling these measures requires an explanation of credit notes, advances, timing differences and supplies that are not sales income.

Compare sales ledgers and invoices with available GST return figures, bank collections and contractual terms. Differences may be valid but should be documented so the income-tax turnover and related disclosures are defensible.

Revenue basis

Understand the accounting method.

GST information

Compare relevant portal summaries.

Credit notes

Record supported sales adjustments.

Receivables

Match unpaid customer balances.

Practical note: GST return filing is a separate approved service; this section only covers figures needed for income-tax reconciliation.

SECTION 06

Profit and Loss Account and Allowable Expenses

Financial-statement profit is the starting point for many business computations, not automatically taxable profit. Expenses such as rent, payroll, professional charges, marketing, utilities and finance costs need correct classification and support before applying income-tax deductibility tests.

We review provisions, personal spending, capital expenditure, related-party entries and items with special deductibility conditions. Adjustments are mapped to their legal basis; amounts should not be added back or claimed merely because a similar adjustment appeared in the previous year.

Revenue

Confirm recognised operating receipts.

Direct costs

Match cost of goods or services.

Overheads

Inspect business purpose and evidence.

Tax adjustments

Apply year-specific deductibility rules.

Practical note: Expense booking in accounting software does not by itself make the amount tax-deductible.

SECTION 07

Balance Sheet, Capital Accounts and Working Capital

Where applicable, balance-sheet schedules should reconcile assets, liabilities, loan accounts, proprietor or partner capital, inventory and year-end balances. Unexplained differences between opening balances and the preceding filed return should be investigated.

Loans and owner contributions should be distinguished from revenue. Drawings and distributions need classification separate from expenses; debtors, creditors and closing stock should be reviewed against business records and reporting schedules.

Capital accounts

Track opening, additions and withdrawals.

Borrowings

Separate principal from finance cost.

Inventory

Check valuation and closing quantities.

Receivables/payables

Confirm year-end outstanding items.

Practical note: Bank inflows may be loans, capital or customer payments; treating every credit as turnover is often wrong.

SECTION 08

Fixed Assets and Income-Tax Depreciation

Computing tax depreciation generally requires an asset-wise record of additions, deletions, opening written-down values, nature of use and applicable block classification. Book depreciation and depreciation permitted under tax law can differ.

We review capitalisation of equipment and software, asset sale proceeds, business-use allocation and relevant depreciation adjustments. Correct records help reconcile the tax computation with fixed-asset balances in the accounts.

Asset register

Document purchases and disposals.

Block mapping

Check tax grouping of assets.

Business use

Review relevant restrictions.

WDV roll-forward

Reconcile opening and closing values.

Practical note: Do not deduct an entire capital asset purchase as a routine operating expense without checking its tax treatment.

SECTION 09

Section 44AD: Presumptive Income for Eligible Business

Section 44AD provides an optional presumptive-profit framework for qualifying resident individuals, HUFs and partnership firms other than LLPs carrying on eligible businesses. For FY 2025–26, the general turnover ceiling is ₹2 crore, increased to ₹3 crore where qualifying cash receipts do not exceed 5% of total turnover or gross receipts, subject to the prescribed conditions.

The statutory presumptive percentages generally include 8% of eligible turnover or receipts and 6% for qualifying receipts through permitted banking or digital modes, or a higher profit declared by the taxpayer. Certain agency, commission and other businesses are excluded; prior election restrictions and other conditions must be evaluated.

Entity eligibility

Resident qualifying taxpayer only.

Turnover test

Check ₹2cr / conditional ₹3cr limit.

Receipt mix

Reconcile cash and digital collections.

Profit basis

Review permitted 6%/8% categories.

Practical note: Presumptive filing is not automatically available just because a business is small.

SECTION 10

Sections 44ADA and 44AE: Professionals and Goods Carriages

Section 44ADA concerns specified professions carried on by eligible resident individuals or partnership firms other than LLPs. The general gross-receipts ceiling is ₹50 lakh, with a conditional ₹75 lakh ceiling where qualifying cash receipts do not exceed 5%; deemed professional income is generally 50% of gross receipts or a higher declared amount.

Section 44AE is a separate method for qualifying businesses of plying, hiring or leasing goods carriages where the taxpayer meets the vehicle ownership conditions. The computation follows vehicle-specific statutory rules and should not be treated as the same as 44AD or 44ADA.

44ADA profession

Confirm activity and entity eligibility.

Receipt ceiling

Assess ₹50L / conditional ₹75L.

44AE vehicles

Review ownership counts and class.

Return form

Recheck all ITR-4 restrictions.

Practical note: Presumptive provisions simplify certain computations but do not remove every record or disclosure obligation.

SECTION 11

Partnership Firm and LLP ITR Reporting

A partnership firm and an LLP are distinct taxpayers from their partners for return-filing purposes. Their ITR-5 reporting may involve profit share, partner capital accounts, drawings, remuneration, interest and other arrangements arising from the governing agreement.

Partner remuneration or interest is not automatically deductible simply because it appears in the books; the relevant statutory limitations and partnership terms need review. LLP eligibility is different from the simplified ITR-4 regime, even where turnover is modest.

Entity PAN

Prepare the firm or LLP return.

Partnership deed

Check authorised remuneration terms.

Partner accounts

Reconcile drawings and balances.

ITR-5 schedules

Cross-check allocations and disclosures.

Practical note: Partner-level personal returns are separate from the firm or LLP return and require their own correct reporting.

SECTION 12

Company Business ITR and Corporate Schedules

Companies generally use ITR-6 unless a special statutory return category applies, including where section 11 exemption is claimed. Corporate returns can require financial-statement schedules, shareholding or other corporate particulars and relevant adjustments to reported book profit.

Company tax computations may involve distinct regimes, minimum alternate tax questions and supporting audit or reporting requirements depending on the entity and year. We coordinate the records needed for the applicable schedules without implying that every business shares the same company rules.

Company identity

Verify PAN and CIN.

Financial statements

Cross-check filed accounts.

ITR-6 schedules

Review company-specific fields.

Verification

Use the prescribed signing method.

Practical note: MCA annual filings and company income-tax returns are related records but are separate approved compliance services.

SECTION 13

Tax Audit: Section 44AB and Audit Report Alignment

For FY 2025–26, section 44AB of the Income-tax Act, 1961 governs tax-audit requirements. The general business turnover benchmark is ₹1 crore, with a conditional ₹10 crore benchmark where both qualifying cash receipts and cash payments are within 5% limits; other audit triggers, including presumptive-tax exceptions, also need attention.

Where an audit is required, the report is prepared and furnished in the prescribed Form 3CA/3CB with Form 3CD particulars as applicable by the authorised professional. The return figures should reconcile to the applicable audit report and account records; tax-return assistance is not a substitute for an independent audit engagement.

Audit applicability

Review turnover and exceptions.

Cash proportion

Test receipts and payments separately.

Report forms

Check 3CA/3CB/3CD selection.

Reconciliation

Align report and ITR schedules.

Practical note: The conditional ₹10 crore threshold depends on both receipts and payments tests, not only sales received digitally.

SECTION 14

Business Losses, Tax Adjustments and Carry-Forward

Business losses, unabsorbed depreciation and specified disallowances follow different treatment and carry-forward conditions. Current-year set-offs are not identical to brought-forward set-offs, and return-filing conditions may affect eligibility for carrying certain losses forward.

We review prior ITR acknowledgements, existing loss schedules, eligible tax credits and adjustments such as timing-sensitive deductions to avoid double counting. Special capital-loss, speculative activity or other ring-fenced categories must not be merged casually into ordinary business losses.

Loss schedules

Trace year-wise opening figures.

Set-off type

Check applicable income restrictions.

Disallowances

Identify supporting statutory basis.

Carry-forward

Verify eligible periods and conditions.

Practical note: Do not copy an old loss figure into a new return without checking what was already utilised.

SECTION 15

Business ITR Checklist, Submission and Verification

A practical filing pack may include entity PAN and registration data, annual accounts, books and bank reconciliation, GST summaries where relevant, depreciation and loan schedules, prior returns, AIS/Form 26AS, tax challans and audit report details when applicable.

Once the return form and computations are settled, the authorised person reviews disclosures, resolves portal validation messages and completes the required submission and verification method. Store acknowledgements and track post-filing communications; the suitable correction route depends on statutory eligibility and the nature of any later error.

Entity documents

Confirm PAN and signing authority.

Financial records

Finalise year-end statements.

Tax evidence

Match TDS/TCS and challans.

Filing controls

Review, verify and retain records.

Practical note: Please use a secure channel for detailed financial data; do not provide portal passwords or OTPs in a public form.

SECTION 16

Business ITR Filing — Frequently Asked Questions

For an individual carrying on business, ITR-3 is commonly relevant. ITR-4 may be available if presumptive taxation and all simplified-form eligibility tests are satisfied.

A qualifying resident partnership firm other than LLP may use ITR-4 if it meets the eligible presumptive-income rules and the other form restrictions; otherwise ITR-5 generally applies.

No. The ITR-4 eligibility framework excludes LLPs; an LLP generally files the relevant ITR-5.

ITR-6 generally applies to companies not claiming exemption under section 11. Special facts and year-specific schedules should be checked.

No. Section 44AD has residency, entity, turnover, business-type and other restrictions; eligible turnover limits may differ depending on qualifying cash receipts.

The ordinary ceiling is ₹2 crore; it can be ₹3 crore when the specified cash-receipt condition is satisfied. Separate eligibility conditions still apply.

Specified eligible professionals who meet the residency, entity and gross-receipt conditions may use section 44ADA. The normal ceiling is ₹50 lakh, conditionally ₹75 lakh.

Not always. A conditional higher ₹10 crore audit threshold can apply if the statutory tests for both cash receipts and cash payments are met; other triggers may still apply.

Where GST is applicable, reconcile GST and accounting figures and document valid differences such as credit notes, treatment of advances and non-turnover items.

No. The tax computation may require adjustments for capital, personal, unsupported or specially restricted expenditure under the law for that year.

Carry-forward and set-off depend on loss type, prior filings, years remaining and applicable conditions. The loss schedules should be traced before claiming them.

No. FY 2025–26 is assessed in AY 2026–27 under the Income-tax Act, 1961; tax year 2026–27 onward falls under the 2025 Act framework.

SECTION 17

Official Business Income Tax Resources

Check the Income Tax Department’s official, year-specific help pages and statutory forms before filing. Return selection, presumptive conditions, tax-audit applicability and transition between the two Acts must be assessed for the exact income period.

FY 2025–26 / AY 2026–27 returns and associated tax audits follow the Income-tax Act, 1961. For tax year 2026–27 and later, check the 2025 Act and applicable notified forms. Eligibility and audit conditions are case-specific.
